Terms of Service

The terms on which Fuelsy is provided to you, including the Fuelsy Pro auto-renewable subscription.

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and Sohail, a sole trader based in the United Kingdom and trading as “Fuelsy” (“Fuelsy”, “we”, “us”). By downloading, installing, or using the Fuelsy iOS app, or by using the fuelsy.co.uk website (together, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

These Terms also act as the end-user licence agreement (EULA) for the Fuelsy iOS app.

2. The Service

Fuelsy provides UK fuel price information sourced from the UK Government Fuel Finder API. Fuelsy presents, organises, and analyses that data for you. See our methodology for detail on how the data is collected and processed.

3. Your device and licence

No account is required to use the Service; your usage is tied to your device. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Fuelsy iOS app on Apple devices that you own or control, subject to these Terms and the Apple Media Services Terms.

4. Acceptable use

You agree not to:

  • scrape, harvest, or systematically download data from Fuelsy, the app, or our APIs;
  • reverse engineer, decompile, or disassemble the app, except to the extent such activity is expressly permitted by applicable law;
  • resell, redistribute, or commercially exploit the data;
  • use the Service in any way that interferes with its operation or with other users; or
  • use the Service in breach of applicable law.

5. Fuelsy Pro auto-renewable subscription

Some features of the Fuelsy iOS app (together, “Fuelsy Pro”) are available through an auto-renewable subscription purchased through the Apple App Store. The following terms apply to Fuelsy Pro and are designed to meet Apple’s App Store requirements for auto-renewable subscriptions.

5.1 Subscription name and length

  • Product: Fuelsy Pro.
  • Monthly plan: £2.99 per month, billed every 1 month.
  • Annual plan: £19.99 per year, billed every 12 months.

The actual price shown in the app at the point of purchase is the price you pay, in your local currency where available, and takes precedence over the amounts listed above.

5.2 Free trial

New subscribers may be offered a 7-day free trial of Fuelsy Pro. If you choose to purchase a subscription, any unused portion of the free trial is forfeited at the point of purchase. You can cancel at any time during the free trial via your Apple ID subscription settings and you will not be charged.

5.3 Payment

Payment is charged to your Apple ID at confirmation of purchase. All payments are processed by Apple; Fuelsy does not receive your card, bank, or billing details.

5.4 Auto-renewal

Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.

5.5 Managing and cancelling your subscription

You can manage your subscription and turn off auto-renewal in your Apple ID subscription settings at any time (Settings → your name → Subscriptions on iOS). Cancelling takes effect at the end of the current billing period; you will keep access to Fuelsy Pro until then.

5.6 Price changes

We may change subscription prices. Where the change increases the price you pay, Apple will notify you in advance and ask you to confirm the new price before it takes effect. Continued use of Fuelsy Pro after a price change is accepted constitutes your agreement to the new price.

5.7 Refunds

All subscription payments are handled by Apple. Refund requests are therefore subject to Apple’s refund policy and must be made through reportaproblem.apple.com. We are not able to issue refunds directly.

6. Accuracy of fuel price data

Fuel prices in the Service are reported by retailers to the UK Government Fuel Finder API and may not always reflect the exact price displayed at the pump at the moment you arrive. Fuelsy provides the information on an “as is” basis; you should check the posted pump price before purchasing fuel.

7. Intellectual property

The Fuelsy app, website, branding, and original content are owned by Fuelsy. Fuel price data is provided under the UK Open Government Licence. Nothing in these Terms transfers any intellectual property rights to you other than the licence set out in section 3.

8. Termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that harms us or other users. You can stop using the Service at any time; if you hold a Fuelsy Pro subscription, see section 5.5 for how to cancel.

9. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that fuel prices shown will be accurate at any given moment.

10. Limitation of liability

To the fullest extent permitted by law, our total aggregate liability to you arising out of or in connection with the Service and these Terms is limited to the greater of (a) £100, or (b) the amount you paid us for Fuelsy Pro in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

11. Apple-specific terms

You acknowledge that these Terms are between you and Fuelsy, not Apple, and that Apple is not responsible for the Fuelsy iOS app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that, if you are a consumer resident in another UK nation, you may also bring proceedings in the courts of that nation.

13. Changes to these Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date above and, for material changes, surface a notice in the app. Continued use of the Service after the changes take effect constitutes your acceptance.
